NOTARY PUBLIC OATH OF OFFICE, BONDING
AND RECORDING
Every Notary, upon appointment and prior to entering
upon the duties of the
office of notary public, shall:
- Take and subscribe the constitutional oath of office.
- Give a surety bond, payable to the Commonwealth of Pennsylvania
in the amount of $10,000.00 and record it with the Recorder of Deeds
in the proper county.
- File the approved bond with the Secretary of the Commonwealth.
Upon recording the bond with the Recorder of Deeds, the Recorder
of Deeds will file the bond with the Secretary of the Commonwealth.
The $10,000 bond for the notary public commission shall be issued by
a duly authorized surety company or the notary applicant can have two
sufficient individual sureties, to be approved by the Secretary of the
Commonwealth, to act as surety for the faithful performance of the duties
of the office of notary public and for the delivery of the notary’s
register to the office of the Recorder of Deeds of the proper county
in case of the death, resignation or disqualification of the notary
within thirty (30) days of such event.
Unless the bond as well as the commission and oath
of office are recorded within the proper office of the recorder of deeds
within the forty-five (45) days of the beginning of the term upon appointment
or reappointment, they shall be null and void. Prior to the new law
effective July 1, 2003 a notary public applicant had thirty (30) days
to take the oath and record the bond. (Section 8
